Bone Dry Freight Terms & Conditions
Welcome to Bone Dry Freight. These Terms & Conditions ("Agreement") govern your use of our website and the transportation and logistics services provided by Bone Dry Freight ("Bone Dry Freight," "we," "our," or "us").
By requesting a quote, scheduling a shipment, using our website, or engaging our services, you agree to be bound by these Terms & Conditions.
1. Services
Bone Dry Freight provides freight transportation, logistics coordination, brokerage, and related transportation services throughout the United States, subject to carrier availability and applicable laws and regulations.
Acceptance of a shipment is subject to equipment availability, route limitations, legal requirements, and our sole discretion.
2. Customer Responsibilities
The customer represents and warrants that:

  • All shipment information provided is complete and accurate.

  • The freight is properly packaged and prepared for transportation.

  • The shipment complies with all applicable federal, state, and local laws.

  • Any hazardous materials are properly identified, documented, packaged, and declared in accordance with applicable regulations.

  • The customer has the legal authority to tender the shipment.

The customer is responsible for all costs resulting from inaccurate shipment information.
3. Bill of Lading (BOL) Requirements
A complete Bill of Lading (BOL) must be provided before pickup.
The BOL must include:

  • Pickup company name

  • Pickup address

  • Pickup contact name

  • Pickup telephone number

  • Pickup email address (if available)

  • Delivery company name

  • Delivery address

  • Delivery contact name

  • Delivery telephone number

  • Delivery email address (if available)

  • Accurate freight description

  • Freight class (when applicable)

  • Number of pieces

  • Weight

  • Dimensions

  • Special handling instructions

  • Hazardous material information, when applicable

Bone Dry Freight may delay or refuse pickup if required documentation is incomplete or inaccurate.
4. Pricing and Quotes
All quotes are based on the information provided by the customer.
Additional charges may apply if:

  • Weight differs from quoted weight

  • Dimensions change

  • Freight class changes

  • Pickup or delivery locations change

  • Additional services are requested

  • Waiting time exceeds standard allowances

  • Special equipment becomes necessary

Quotes are subject to change until a shipment has been accepted.
5. Payment Terms
Unless a customer has been approved for credit terms in writing by Bone Dry Freight, payment is required prior to pickup.
Accepted payment methods may include major credit cards, ACH transfers, wire transfers, or other approved payment methods.
Invoices issued to customers with approved credit terms are due according to the agreed payment terms. Late payments may incur interest, collection costs, attorney's fees, and other amounts permitted by law.
6. Cancellations
Customers may cancel shipments before a carrier has been dispatched.
Once a carrier has been assigned or dispatched, cancellation charges may apply, including:

  • Dispatch fees

  • Broker service fees

  • Carrier cancellation fees

  • Deadhead mileage

  • Driver compensation

  • Truck Ordered Not Used (TONU) fees

  • Administrative expenses

7. Pickup and Delivery
Pickup and delivery dates are estimated unless expressly agreed otherwise in writing.
Bone Dry Freight is not responsible for delays resulting from:

  • Weather

  • Traffic

  • Mechanical failures

  • Government actions

  • Road closures

  • Labor disputes

  • Force majeure events

  • Customer delays

  • Delays caused by shippers, consignees, or third parties

8. Inspection of Freight
The shipper is responsible for ensuring freight is properly packaged, labeled, and ready for transportation.
The consignee should inspect freight upon delivery before signing the delivery receipt.
Visible damage or shortages should be noted on the delivery receipt at the time of delivery.
9. Cargo Claims
Claims for loss, shortage, or damage must be submitted promptly and include supporting documentation, which may include:

  • Photographs

  • Delivery receipt

  • Bill of Lading

  • Proof of value

  • Repair estimates or replacement invoices

  • Any other documentation reasonably requested

Transportation charges remain due regardless of any cargo claim unless otherwise required by law.
10. Limitation of Liability
To the fullest extent permitted by law, Bone Dry Freight shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost business opportunities, or business interruption arising from the use of our services.
Our liability, if any, shall be limited to the extent permitted under applicable law and any governing transportation agreement.
11. Customer Indemnification
The customer agrees to defend, indemnify, and hold harmless Bone Dry Freight and its owners, officers, employees, agents, contractors, and affiliates from any claims, damages, losses, liabilities, fines, penalties, costs, and expenses arising out of:

  • Inaccurate shipment information

  • Improper packaging

  • Hazardous materials violations

  • Violations of applicable laws

  • Customer negligence

  • Breach of this Agreement

12. Website Use
Users agree not to:

  • Attempt unauthorized access to our systems

  • Interfere with website operation

  • Upload malicious software

  • Use automated tools to scrape website content without authorization

  • Violate applicable laws while using our website

We reserve the right to restrict or terminate access for misuse.
13. Intellectual Property
All website content, including logos, graphics, text, photographs, trademarks, and other materials, is the property of Bone Dry Freight or its licensors and may not be copied, reproduced, distributed, or used without prior written permission.
14. Privacy
Your use of our website is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
15. Refunds
Refund eligibility is governed by the Bone Dry Freight Refund Policy. In the event of a conflict between these Terms & Conditions and the Refund Policy, these Terms & Conditions will control unless otherwise required by law.
16. Force Majeure
Bone Dry Freight shall not be liable for failure or delay in performing its obligations due to events beyond its reasonable control, including natural disasters, severe weather, war, terrorism, civil unrest, pandemics, governmental actions, utility failures, labor disputes, cyber incidents, or other force majeure events.
17. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.
Any legal action arising out of these Terms & Conditions shall be brought in a court of competent jurisdiction located in the State of Nevada, unless otherwise required by applicable law.
18. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
19. Changes to These Terms
Bone Dry Freight reserves the right to modify these Terms & Conditions at any time. Updated versions become effective upon posting to our website. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
